Terms of Service

Who we are

Photo Lab is operated by Murphy Tech, a sole proprietorship based in the United States (“we”, “us”). These terms are an agreement between you and Murphy Tech. By creating an account or using Photo Lab, you agree to them and to our Privacy Policy.

The service

Photo Lab lets you upload photos and edit them with AI tools.

Your account

You must be at least 18. Give a valid email address, and keep your password safe: you are responsible for activity on your account.

Your photos

You keep all rights to your photos and the edited versions. You confirm that you have the right to upload each photo, and permission from the people in it where the law requires it.

You give us permission to store and process your photos, and to send them to the AI providers named in the Privacy Policy, only to provide the service to you. This permission ends when you delete the photo or your account, apart from backups, which are replaced within 7 days.

What you must not do

• Upload illegal content, or any content showing minors in a sexual way. We report child sexual abuse material to the authorities.
• Create sexual or intimate images of a real person without their consent.
• Edit photos of real people to deceive, defraud, harass, threaten or defame anyone, or to pass off fake images as real.
• Infringe anyone's copyright, privacy or other rights.
• Attack, overload or probe the service, get around its limits, scrape it, or access other people's accounts or data.
• Resell or share access to your account.

AI providers apply their own content rules, so some edits may be refused even when they follow these terms.

Subscription and credits

• The subscription renews monthly at the price shown at checkout until you cancel. Payments are handled by Stripe.
• Each billing period includes a fixed number of credits. Credits are used by AI edits, cannot be transferred, have no cash value, and do not roll over.
• Edits that fail with an error are refunded automatically. Results are generated by AI and may not match what you hoped for; a result you dislike does not count as a failure.
• You can cancel at any time in the billing portal and keep access until the end of the paid period. Except where the law requires otherwise, payments are not refundable.
• If we change the price, we will tell you at least 30 days before it applies to your subscription.

Suspension and ending

You can delete your account at any time from the account menu. We may suspend or close accounts that break these terms or put the service or other people at risk. Unless the breach is serious, or the law prevents it, we will tell you first. If we close a paid account for reasons other than a breach of these terms, we will refund the unused part of the current period.

Availability

The service is provided “as is” and “as available”. AI results can be imperfect or unexpected. We do not guarantee uninterrupted service or that your files can never be lost, so keep your own copies of photos you care about. We may change or stop features, and if we shut Photo Lab down we will give at least 30 days' notice so you can download your photos.

Liability

To the extent the law permits, we are not liable for indirect, incidental or consequential losses, or for lost data, profits or goodwill. Our total liability to you for any claim is limited to the larger of the amount you paid us in the three months before the claim, or $50. Some places do not allow these limits, and then they apply only as far as allowed. You agree to cover our reasonable costs from claims made against us because of content you uploaded or your breach of these terms.

Law

These terms are governed by the laws of the State of Utah and of the United States, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be heard in the state or federal courts located in Utah. Before going to court, please email us so we can try to resolve the problem informally. Nothing here takes away rights you have under the consumer protection laws where you live.

Changes and contact

We may update these terms. For important changes, we will tell you by email or in the app before they take effect; if you keep using Photo Lab afterwards, the new terms apply. Questions: [email protected].
